DOJ says it will appeal ruling against travel mask mandate if CDC calls for it

The Department of Justice announced that it would consider an appeal of the recent ruling that voided the federal mask mandate on public transit, if the Centers for Disease Control and Prevention deems it necessary.  The Justice Department said in a statement Tuesday: “The Department of Justice and the Centers for Disease Control and Prevention (CDC) disagree with the district court’s decision and will appeal, subject to CDC’s conclusion that the order remains necessary for public health. If CDC concludes that a mandatory order remains necessary for the public’s health after that assessment, the Department of Justice will appeal the district court’s decision.”  Though the federal government was expected to appeal the decision, neither President Joe Biden nor White House press secretary Jen Psaki indicated which way the DOJ was leaning until the announcement on Tuesday evening.

On Monday, a Florida judge struck down a federal mask mandate that applied to public transportation, effectively lifting the requirement on planes, trains and buses, as well as inside airports across the United States. In the ruling, U.S. District Court Judge Kathryn Mizelle said the mandate, established by the CDC, exceeds “statutory authority and violates the procedures required for agency rulemaking under the [Administrative Procedure Act].”  The judge’s decision was effective immediately.

Whether the CDC still thinks the mandate on public transit is an important public health tool remains to be seen.   Just last week, the agency extended the travel mask mandate until May 3 to monitor an uptick in cases from the BA.2 variant, a more transmissible strain of omicron. If the CDC does move to reimpose the mandate, it’s unclear whether action from the Justice Department at this point will lead to change before the mandate was set to expire.

Biden administration launches $6B effort to save distressed nuclear power plants

The Biden administration is launching a $6 billion effort to save nuclear power plants at risk of closing, citing the need to continue nuclear energy as a carbon-free source of power that helps to combat climate change. A certification and bidding process was opened Tuesday by the U.S. Department of Energy for a civil nuclear credit program that is intended to bail out financially distressed owners or operators of nuclear power reactors, making it the largest federal investment in saving financially distressed nuclear reactors.

Owners or operators of nuclear power reactors that are expected to shut down for economic reasons can apply for funding to avoid closing prematurely. The first round of awards will prioritize reactors that have already announced plans to close. The second round will be opened up to more economically at-risk facilities. The program was funded through President Biden’s $1 trillion infrastructure deal, which he signed into law in November.

Most US nuclear plants were built between 1970 and 1990; the only nuclear plant under construction in the United States is in Georgia. Shuttered reactors include Indian Point Energy Center in New York, Pilgrim Nuclear Power Station in Massachusetts, Fort Calhoun Nuclear Generating Station in Nebraska and Duane Arnold Energy Center in Iowa. New York officials sought the shutdown of Indian Point, saying the plant 24 miles north of Manhattan posed too great a risk to millions of people who live and work nearby.

There are 55 commercial nuclear power plants with 93 nuclear reactors in 28 US states.  If reactors do close before their licenses expire, fossil fuel plants will likely fill the void and emissions will increase, which would be a substantial setback

Old Dominion is looking forward to their “dream gig” opening for Kenny Chesney

There’s many reasons Old Dominion is looking forward to hitting the road with Kenny Chesney, one of which being able to watch the crowd’s reaction when they perform “I Was on a Boat That Day.”

The single peaked inside the top 10 on the country charts in 2021, and has since become a crowd pleaser at their live show. Knowing how passionately their fans sing it, the band can’t wait to hear Kenny’s fervent audience add their voices to it.

“I can’t wait to see that song in that environment,” frontman Matthew Ramsey says of the song that was “made for” a stadium-sized show. “As soon as I count that song off, everyone knows immediately what it is. The hands go up, it’s awesome. There’s something about the groove too that makes you want to dance doesn’t really matter what it says. It’s just fun.” “It’s always fun to see a crowd light up when it starts. In our heads we’re so used to chasing that chart number, and then you’re like, ‘they’re into it,'” adds bandmate Geoff Sprung.

And the band is just as excited to reunite with the headliner himself, as they’ve toured with Kenny multiple times to the point where they refer to his crew as “family.”

“That’s the dream gig to go on tour with him. Everybody wants to experience that and should be so lucky to experience it once, and this happens to be our fourth time,” Matt expresses. “We’re good friends at this point with him and his whole crew, and we love it so much. It’s a family reunion at this point, so we’re so happy to go back out there with Kenny.”

The Here and Now Tour kicks off on April 23 at the Raymond James Stadium in Tampa, FL.

Dustin Lynch & MacKenzie Porter make history on Billboard Country Airplay Chart with “Thinking ‘Bout You”

Dustin Lynch and Mackenzie Porter are making history with their collaboration “Thinking ‘Bout You,” which is now the longest-running Top 10 single on the Billboard Country Airplay chart (27 weeks) since the chart launched in January 1990.  The tune held the No. 1 spot for six-weeks in February 2022.  Lynch said: Wow! Adding this stat to ‘Thinking ‘Bout You’ is so huge. It further validates what we all felt with this song, and it’s so rewarding to see it continue to connect with listeners. Y’all keep blowing us away with this song!”

Luke Combs’ song “Forever After All” was the last single to spend five weeks or more on Billboard’s Country Airplay chart before Thinking ‘Bout You overtook its spot at six weeks in the leading spot.  Thinking ‘Bout You, co-written by Lynch with Andy Albert, Hunter Phelps and Will Weatherly, is Lynch’s eighth No. 1 hit in the United States and his second No. 1 hit in Canada at Country radio, as well as his third career No. 1 as a songwriter.  Porter earned her first-ever No. 1 in the United States and her fourth Canadian No .1.

Lynch is currently in the midst of his 17-city headlining Party Mode Tour. For additional details on Lynch’s tour or for tickets, visit DustinLynchMusic.com.

Luke Bryan leaves crumbs (and selfies) in his and Katy Perry's Las Vegas suite

Luke Bryan and Katy Perry are sharing a suite in Las Vegas, and it sounds like Luke isn’t the best house guest.

The two singers are performing their respective residencies at Resorts World throughout the year and are staying in the same suite while in town, albeit at different times. And when his fellow American Idol judge isn’t there, Luke takes it upon himself to leave subtle reminders of his presence.

“I leave crumbs in the couch. I did send a selfie of the toilet, I’m like, ‘Katy, here’s where it all goes down right here,'” he tells Access, laughing. The hit singer confirms that he was “clothed” in the photo and did flush the toilet so as not to be too crass. “Courtesy for Katy,” he adds with a smile.

It should come as no surprise that the country star messes with their mutual suite, admitting that the two playfully disagree while on the set of American Idol when it comes to selecting which singers to advance on to the next rounds.

“We got to butt heads every now and then to keep it interesting, but we’re having fun,” Luke says. “We’re all quite amicable.”

American Idol airs on Sunday and Monday nights at 8 p.m. ET on ABC.

Dustin Lynch and MacKenzie Porter break record on 'Billboard' Country Airplay chart with “Thinking 'Bout You”

Dustin Lynch has set a new chart record, as his and MacKenzie Porter‘s duet, “Thinking ‘Bout You,” is now the longest-running top-10 hit in the history of the Billboard Country Airplay chart.

After parking at #1 on the chart for six weeks, the song has now spent 27 weeks inside the top 10; it currently sits at #8. “Thinking ‘Bout You” has surpassed the record previously set by Jason Aldean and Carrie Underwood‘s hit duet, “If I Didn’t Love You,” that was in the top 10 for 26 weeks.

Rounding out the list of singles that have spent the most weeks in the top 10 of the chart since its inception in 1990 are “Famous Friends” by Chris Young and Kane Brown, which spent 23 weeks in the top 10; Lonestar‘s “Amazed” at 21 weeks; and, tied with a 20-week stay, “One of Them Girls” by Lee Brice and “Somebody Like You by Keith Urban.

“Y’all keep blowing us away with this song!” Dustin commented on Instagram.

“Thinking ‘Bout You” was originally recorded with Lauren Alaina as Dustin’s duet partner and was featured on his 2020 album, Tullahoma. But he re-recorded it in 2021 with MacKenzie and it became his longest-running #1 hit.
